Liberate Capital is a trading style of Thames Valley Asset Finance Limited (‘’Us’’).

This Privacy Statement sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. We will ensure that all personal information supplied is held securely in accordance with the General Data Protection Regulation (EU) 2016/679 as adopted into the law of the United Kingdom in the Data Protection Act 2018

For the purpose of the General Data Protection Regulation (EU) 2016/679, Thames Valley Asset Finance Limited trading as Liberate Capital  registered and trading address is at 7 West Mills Yard, Kennet Road, Newbury, Berkshire, RG14 5LP. Our Data Controller is Andrew Wise.

 

Data That May Be Collected

• We may collect certain personal data with respect to you as a customer, including, without limitation your name, address, date of birth, contact details, credit reference data, financial and employment details, banking and credit card details, and details of your business if applicable. We may collect some of this data from third parties, for example credit reference agencies.
• Where a corporate entity is entering into a Loan we will collect personal data about the individuals who are directors and shareholders of the business from third parties where this data is held publicly, such as at Companies House. This notice also applies to the processing of such personal data and use of the word ‘you’ in this notice will encompass such individuals.

• We may process sensitive personal data (including, for example, information revealing an individual’s physical or mental health). Where sensitive personal data is processed we will obtain your explicit consent for the processing.

 

Use of Personal Data

We will use your personal data for: provision of products and services, credit and Anti Money Laundering risk assessment, assessing ongoing credit performance, recoveries, collections, market research and product development, statistical analysis, fraud prevention and detection and otherwise as necessary to comply with applicable laws, regulations and/or codes of practice. The processing of personal data may be necessary for the performance of a contractual relationship, compliance with a legal obligation, or where it is in the legitimate interests of Liberate Capital.  We may use information held about you in one or more of the following ways:

• To provide you with information, products or services that you request from us;
• To carry out our obligations arising from any Loan entered into between you and Lenders;
• To notify you about changes to our service;
• We may also use your data to provide you with information about services which may be of interest to you and we may contact you about these by post or telephone or e-mail.
• If you are an existing customer, we will only contact you by electronic means (e-mail or SMS) with information about services similar to those which were the subject of a previous sale to you. If you are a new customer, we will contact you by electronic means only if you have consented to this.
• We may also permit selected third parties to contact you about goods and services which may be of interest to you by post, telephone and email but only where you have consented to this.

• If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant boxes situated on the form on which we collect your data.

 

Security

We will take steps to protect your personal data against loss or theft, as well as from unauthorised access, disclosure, copying, use or modification, regardless of the format in which it is held.

We will normally retain your personal data for a period of seven years from the latest date on which we have a financial arrangement in place with you. Under certain circumstances this period may vary if we consider it necessary for good operational or commercial reasons, or in order to meet other legal obligations

 

Disclosure of your information

• We will disclose your information to Lenders in order to fulfil any loan applications made by you. All finance is provided by third party Lenders and where you submit a loan application, your personal information will be passed on to the relevant Lenders for the purposes of your loan application.
• Please be aware that once you use our services, you will be regarded as having given your consent to us disclosing your personal information to the following parties:
• Lenders for the purposes of obtaining approval or rejection of your Finance application and fulfilling any Application made by you;
• The Financial Conduct Authority and/or other regulatory or governing bodies for the purposes of compliance monitoring;
• Licensed credit reference agencies for the purposes of carrying out credit checks in relation to your Application;
• Other third parties where necessary for those third parties to provide additional products or services requested by you or with your prior consent;
• In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
• If Liberate Capital or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets;

The personal information we have collected will be shared with Lenders who will use it to prevent fraud and money-laundering and to verify your identity. If fraud is detected you could be refused certain services or finance. Personal information collected will be used to:

• Assess your creditworthiness:
• Verify the accuracy of the data you have provided:
• Prevent criminal activity, fraud and money laundering:
• Manage your finance agreement or loan:
• Assist a Lender in tracing and recovering debts:
• Ensure any offers provided to you are appropriate to your circumstances.

 

Third Party Lenders and Data Privacy

If you decide to enter into a Loan with a Lender as a result of an application submitted via Liberate Capital, the information you have provided to us together with any further information requested by, and supplied by you to the Lender, will be held by the Lender for the purposes set out in that Lender’s own privacy policy.

You are strongly advised to read your chosen Lender’s privacy policy and satisfy yourself as to the purposes for which the Lender will use your personal information before entering into a Loan Contract. We have no responsibility for the uses to which a Lender puts your personal information once you have contracted with that Lender.

 

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data.
